• Inbound call handling
• Lead qualification and smart routing
• Live transfers
• Digital advertising (Google Ads, Meta Ads, etc.)
• SEO / SEM support
• Social media and content services
• Branding, design, and website development
• Automation, CRM integrations, and technical support

We may update, modify, or discontinue any service at any time.

2. Client Responsibilities

To ensure proper delivery of services, you agree to:

• Provide accurate business information, call criteria, and qualification rules
• Maintain active communication with our team
• Provide required access to advertising accounts, CRM systems, or platforms
• Comply with all applicable laws and regulations
• Use our services only for lawful business purposes

You are responsible for the accuracy of any instructions, scripts, or criteria you provide.

3. Payments & Billing

Services are billed according to the pricing agreed upon during onboarding or contract signing.

Payment models may include subscription-based, usage-based, or project-based fees.

Invoices must be paid on time to avoid service interruption.

Late or failed payments may result in suspension or termination of services.

Advertising platform fees (Google, Meta, etc.) are billed separately unless otherwise agreed.

All payments are non-refundable unless required by law or explicitly stated in writing.

4. Call Handling & Lead Transfers

By using our call services, you acknowledge that:

• We qualify leads based on the criteria you provide
• We cannot guarantee the outcome of any call or sale
• Lead quality may vary depending on market conditions
• You are responsible for handling the lead after transfer

We do not guarantee a specific number of calls, leads, or conversions unless stated in a written agreement.

5. Advertising & Marketing Services

When using our advertising or marketing services:

• You authorize us to manage campaigns on your behalf
• Advertising performance may vary
• Results depend on market conditions, competition, and budget
• You agree to comply with platform policies (Google, Meta, etc.)

We are not responsible for account suspensions caused by violations outside our control.

6. Intellectual Property

Unless otherwise agreed:

• All branding, design, creative assets, and website materials produced by GetCalledNow remain our intellectual property until paid in full
• Upon full payment, you receive a license to use the materials for your business
• You may not resell, redistribute, or claim authorship of our work

Your logos, trademarks, and business materials remain your property.

7. Confidentiality

Both parties agree to keep all non-public information confidential, including:

• Scripts, processes, and internal documentation
• Client lists and business data
• Call recordings and lead information
• Advertising strategies and performance data

Confidentiality obligations survive termination of services.

8. Data & Privacy

Our handling of personal data is governed by our Privacy Policy.

By using our services, you consent to the collection and processing of data as described there.

You are responsible for ensuring your own compliance with applicable privacy laws (e.g., GDPR, CCPA) if they apply to your business.

9. Limitation of Liability

To the fullest extent permitted by law:

• GetCalledNow is not liable for indirect, incidental, or consequential damages
• We do not guarantee specific business outcomes, revenue, or performance
• Our total liability is limited to the amount you paid us in the last 30 days
• You agree to use our services at your own risk

10. Termination

Either party may terminate services with written notice, subject to any contractual terms.

We may suspend or terminate services immediately if:

• Payments are overdue
• You violate these Terms
• You engage in fraudulent, abusive, or illegal activity

Upon termination, all outstanding balances must be paid.

11. Changes to These Terms

We may update these Terms from time to time.

The "Last Updated" date reflects the most recent version.

Continued use of our services constitutes acceptance of any changes.

12. Governing Law

These Terms are governed by the laws of the State of Florida, USA, unless another jurisdiction is specified in your contract.

Any disputes will be resolved in the appropriate courts of that jurisdiction.
